Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you", "your") and The Odds Terminal (ABN 97 938 372 625) ("The Odds Terminal", "we", "us", "our"), the operator of the website at theoddsterminal.com.au and the related odds‑comparison and sports‑data tools (together, the "Service").

By accessing, browsing, subscribing to, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

1. What The Odds Terminal is — and what it is not

1.1 The Odds Terminal is an information and comparison service. We aggregate and display publicly available betting odds, prices, statistics, and related sports data sourced from third‑party bookmakers and data providers, and we present tools (including same‑game‑multi price comparison, single‑market comparison, player statistics, and value/EV analysis) to help you compare that information.

1.2 We are not a bookmaker, wagering service provider, gambling operator, or financial services provider. We do not:

• accept, place, facilitate, or settle bets or wagers of any kind;
• hold, transfer, or handle any betting funds or stakes;
• operate any gambling product; or
• act as agent for you or for any bookmaker.

1.3 We are not affiliated with, endorsed by, or sponsored by any bookmaker named or linked on the Service, unless we expressly state otherwise. Bookmaker names and logos are the property of their respective owners and are used only to identify the source of the odds we compare.

1.4 Not advice. Nothing on the Service constitutes financial, investment, betting, taxation, or legal advice, and nothing is a recommendation, tip, inducement, or encouragement to place any particular bet or to gamble at all. The Service provides data; any betting decision is yours alone. See Sections 7 and 12.

2. Eligibility and age restriction

2.1 You must be at least 18 years of age to access or use the Service. Gambling‑related information is restricted to adults.

2.2 By using the Service you represent and warrant that you are 18 or older, that you are legally permitted to access betting‑related information in your jurisdiction, and that your use of the Service does not breach any law that applies to you.

2.3 We may request proof of age at any time and may suspend or terminate access where we reasonably believe a user is under 18 or has provided false information.

3. Accounts

3.1 Some features require an account. You agree to provide accurate, current, and complete information and to keep it up to date.

3.2 You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at theoddsterminal@gmail.com of any unauthorised use.

3.3 Accounts are personal to you. You must not share, sell, transfer, or sub‑licence your account or access. We may limit accounts to one per person and one per payment method.

4. Acceptable use and licence

4.1 Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable licence to access and use the Service for your own personal, non‑commercial purposes.

4.2 You must not, and must not permit any other person to:

• scrape, harvest, crawl, copy, cache, republish, redistribute, sell, or commercially exploit any data, odds, statistics, or content from the Service;
• access the Service by any automated means (bots, scripts, data‑mining) except as we expressly permit;
• reverse engineer, decompile, or attempt to derive the source code of the Service;
• circumvent, disable, or interfere with any security, rate‑limiting, or access‑control feature;
• resell, redistribute, or provide the Service (or its outputs) to third parties;
• use the Service in any way that is unlawful, that infringes our or a third party's rights, or that could damage, disable, or impair the Service.

4.3 We may monitor use and may suspend or terminate access for any breach of this Section.

5. Subscriptions, billing, and refunds

This Section applies to paid plans. Some access may also be offered free or via waitlist; where you are not on a paid plan, the billing and renewal terms below do not apply to you.

5.1 Plans and pricing. Paid features are offered on a subscription basis in Australian dollars (AUD). Current plans, prices, and billing periods are shown at checkout. Prices are inclusive of GST where applicable.

5.2 Payment processing. Payments are processed by our third‑party payment processor (Stripe). We do not store your full card details. Your use of the payment processor is subject to its own terms and privacy policy.

5.3 Auto‑renewal. Subscriptions renew automatically at the end of each billing period at the then‑current price until cancelled. By subscribing, you authorise us (via our payment processor) to charge your payment method for each renewal.

5.4 Cancellation. You may cancel at any time, effective at the end of the current billing period. After cancellation you retain access until the period ends; we do not provide pro‑rata refunds for the unused part of a period except as required by law.

5.5 Refunds and the Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms limits those rights. Subject to those rights, subscription fees are otherwise non‑refundable. If the Service fails to meet a consumer guarantee, you may be entitled to a remedy under the ACL.

5.6 Price changes. We may change plans or prices. We will give you reasonable advance notice of any price increase that affects you, and the new price applies from your next renewal. Continuing to use a paid plan after a change takes effect constitutes acceptance.

5.7 Free trials / promotions. Where offered, free trials convert to paid subscriptions unless cancelled before the trial ends. We may modify or withdraw trials and promotions at any time.

5.8 Taxes. You are responsible for any taxes arising from your use of the Service other than taxes on our income.

6. Third‑party bookmakers, links, and data sources

6.1 The Service displays odds and data sourced from third‑party bookmakers and providers and may link out to bookmaker websites. We do not control those third parties.

6.2 We are not responsible for: the odds, markets, availability, or terms offered by any bookmaker; whether a displayed price is still available when you visit a bookmaker; any bookmaker's acceptance, settlement, restriction, or refusal of any bet; or any bookmaker's treatment of your account or funds.

6.3 Your dealings with any bookmaker are solely between you and that bookmaker and are governed by their terms. Always verify current odds and conditions directly with the bookmaker before placing any bet.

7. Data accuracy, availability, and "as is" basis

7.1 Odds and sports data change rapidly and are obtained from external sources. While we take reasonable care, we do not warrant that any information on the Service is accurate, complete, current, available at any bookmaker, or free from error or delay.

7.2 The Service, including any value, edge, expected‑value, hit‑rate, or comparison output, is provided for general information only and on an "as is" and "as available" basis. We do not guarantee any particular result, profit, "edge", or outcome. Betting involves risk and you may lose money.

7.3 The Service depends on third‑party systems that may change, restrict access, or become unavailable without notice, which may cause inaccuracies, gaps, or downtime. We do not guarantee uninterrupted or error‑free operation and may suspend the Service for maintenance or other reasons.

8. Responsible gambling

8.1 We support responsible gambling. The Service is a data tool and is not an encouragement to gamble. Gamble only with money you can afford to lose, and set limits.

8.3 We encourage you to use the deposit limits, time‑outs, and self‑exclusion tools offered by bookmakers and by services such as BetStop, the National Self‑Exclusion Register (betstop.gov.au).

9. Intellectual property

9.1 The Service — including its software, design, layout, text, graphics, branding, the name "The Odds Terminal", logos, and the selection, arrangement, and presentation of data — is owned by or licensed to us and is protected by intellectual property laws.

9.2 We grant you no rights other than the limited licence in Section 4. You must not use our trade marks or branding without our prior written consent. The licence does not give you any rights in the underlying third‑party data itself.

9.3 If you submit any feedback or suggestions, you grant us a perpetual, royalty‑free licence to use them without obligation to you.

10. Disclaimers and limitation of liability

10.1 Consumer guarantees preserved. Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded.

10.2 Disclaimer. Subject to Section 10.1, and to the maximum extent permitted by law, we exclude all warranties, representations, and guarantees not expressly set out in these Terms, whether express or implied.

10.3 Limitation. Subject to Section 10.1, and to the maximum extent permitted by law, we (and our directors, employees, and suppliers) are not liable for any:

• loss arising from any bet, wager, or gambling activity, or from any betting decision you make;
• loss arising from your reliance on odds, statistics, comparisons, or other content;
• act or omission of any bookmaker or third‑party data source; or
• indirect, incidental, special, consequential, or punitive loss, or loss of profits, revenue, data, or goodwill,

even if advised of the possibility of such loss.

10.4 Liability cap. Subject to Section 10.1, our total aggregate liability arising out of or in connection with the Service or these Terms is limited, at our option, to re‑supplying the relevant service or to the amount of subscription fees you paid to us in the 12 months before the event giving rise to the liability.

10.5 Indemnity. You agree to indemnify us against any loss, claim, or cost (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Service, or your breach of any law or third‑party right.

11. Suspension and termination

11.1 We may suspend or terminate your access to the Service (including any account or subscription) immediately if you breach these Terms, if we are required to by law, or if we reasonably consider it necessary to protect the Service or other users.

11.2 You may stop using the Service at any time and may cancel a subscription as set out in Section 5.

11.3 On termination, your licence ends and you must stop using the Service. Sections that by their nature should survive (including 1, 6, 7, 9, 10, and 14) survive termination.

12. No betting, financial, or professional advice

The Service is general information only. It does not take into account your personal circumstances, financial situation, or objectives. Before acting on any information, consider whether it is appropriate for you and, where relevant, obtain independent professional advice. You are solely responsible for your betting decisions and their consequences.

13. Changes to the Service and to these Terms

13.1 We may add, change, suspend, or remove features of the Service at any time.

13.2 We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date and, where changes are material, take reasonable steps to notify you. Continuing to use the Service after changes take effect constitutes acceptance. If you do not agree, you must stop using the Service.

14. Governing law, jurisdiction, and general

14.1 These Terms are governed by the laws of Victoria, Australia. You and we submit to the non‑exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

14.2 If any provision is found unenforceable, it is severed and the remaining provisions continue in force.

14.3 Our failure to enforce a provision is not a waiver of it.

14.4 You must not assign these Terms without our consent; we may assign them to a successor or purchaser of our business.

14.5 These Terms (with the Privacy Policy) are the entire agreement between you and us about the Service.
